Agreement and scope

These Terms of Service (“Terms”) govern your use of the SixCrd website, PinCrd advertising and community features, and other SixCrd services that link to these Terms (collectively, the “Services”). SixCrd is a Nevada sole proprietorship based in Las Vegas, Nevada (“SixCrd,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

MenuCrd is a planned product and is not currently available for paid bookings. Any future MenuCrd features, pricing, or separate terms will be described when launched. A demonstration or concept preview does not represent an active offer.

Eligibility and acceptable use

The Services are intended for adults age 18 or older. If you submit advertising on behalf of a business or organization, you represent that you are authorized to act for it.

You agree not to use the Services unlawfully; submit fraudulent, misleading, discriminatory, infringing, defamatory, or harmful material; impersonate others; interfere with the Services; attempt unauthorized access; or use automated methods to disrupt or scrape the Services without permission. We may restrict access or remove material that violates these Terms or applicable law.

PinCrd advertising and scheduling

A PinCrd Advertising Pin is a paid local advertising placement. Unless a written order specifies otherwise, a single weekly placement costs $39, and a package of four consecutive weekly placements costs $139. Featured placement is an additional $20 per week, subject to available inventory, with up to four Featured positions per category and area in Eat & Drink, Retail, and Services. All amounts are in U.S. dollars; applicable taxes, if any, may be added.

Each weekly advertising cycle runs Wednesday to Wednesday, with scheduled publication at approximately 6:00 a.m. Pacific Time on Wednesday. Complete advertising materials and requested changes must be received by 12:00 p.m. (noon) Pacific Time on Monday before the scheduled Wednesday publication. We may decline or defer late, incomplete, or noncompliant submissions. Advertisers may provide updated creative for each week of a four-week package without an additional creative-change charge.

Placements, areas, categories, dates, and Featured inventory are subject to confirmation. Purchasing advertising does not guarantee views, clicks, inquiries, customer visits, or sales.

Cancellations and advertiser refunds

Advertisers may cancel a scheduled placement by notifying SixCrd before Monday at noon Pacific Time immediately preceding its Wednesday publication. A timely cancellation is eligible for a refund of the uncommitted placement amount: $39 for an uncommitted single week, $34.75 per uncommitted week in a four-week package, and $20 for each uncommitted Featured placement. Weeks already published or past the Monday cutoff are committed and generally nonrefundable, except as stated below or required by law.

Four-week packages cover consecutive weeks. Canceling future weeks does not retroactively change the price of a completed week. Contact [email protected] with the business name and placement details to request cancellation. Refunds ordinarily go back to the original payment method; payment-provider processing times vary.

Publication failures and service interruptions

SixCrd uses commercially reasonable efforts to publish placements on schedule and maintain service availability, but does not guarantee uninterrupted operation or a particular uptime percentage. Delays and interruptions may result from hosting or network failures, third-party outages (including domain, cloud, and payment providers), distributed denial-of-service attacks, other cyber incidents, natural disasters, government actions, or events beyond our reasonable control.

If a paid placement is not published for its scheduled week, the advertiser may choose either (a) a refund of the amount paid for the affected week and associated Featured placement, if any, or (b) an equivalent replacement week, subject to scheduling and availability.

If a published placement becomes unavailable for 24 consecutive hours or longer during its paid week, the advertiser may request an appropriate remedy. Depending on the duration and effect, SixCrd will offer a reasonable replacement period or a full or prorated refund of the affected placement fee. Outages shorter than 24 consecutive hours do not automatically qualify for a refund or credit, although SixCrd may offer one at its discretion. These remedies do not limit rights that cannot legally be waived.

Advertiser content and responsibility

Advertisers are responsible for the accuracy, legality, availability, and fulfillment of their advertisements and offers, including prices, discounts, expiration dates, restrictions, required disclosures, and permissions to use submitted images or other material. Advertisers must honor applicable offers as advertised and comply with consumer-protection, advertising, intellectual-property, and other relevant laws.

SixCrd provides an advertising platform and is not a party to transactions between advertisers and their customers. We may review, reject, request changes to, correct with advertiser approval, or remove advertising content for accuracy, suitability, legal compliance, or operational reasons. Our review does not constitute verification or endorsement. Nothing here excuses SixCrd's own unlawful or misleading conduct.

Community submissions and permissions

Community areas may feature recipes, stories, poems, book reviews, acknowledgments, and other contributions. By submitting content, you represent that you have the rights and permissions needed to submit it, including consent from people identifiable in photos or stories where required. Do not submit confidential information, private contact details about others without permission, or material that violates another person's rights.

You retain ownership of your original content. You grant SixCrd a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, edit for length and clarity, and distribute the submitted content in connection with the Services and their promotion, for as long as the content remains published and for reasonable archival and backup purposes. You may request removal by emailing us; removal from third-party shares or existing caches may not be possible.

We may accept, decline, edit, or remove community submissions at our discretion, consistent with applicable law. We are not obligated to publish submissions or compensate contributors unless separately agreed in writing.

Third-party websites and services

Listings and pages may link to businesses, maps, menus, payment providers, or other third-party websites and apps. Those services are independently operated and may have their own terms and privacy practices. SixCrd does not control their content, availability, pricing, or fulfillment.

SixCrd intellectual property

Except for advertiser and contributor materials, the Services, designs, text, software, branding, and other original materials belong to SixCrd or its licensors and are protected by applicable law. You may use the Services for their intended purposes but may not reproduce or commercially exploit SixCrd materials without permission, except as allowed by law.

Disclaimers and limits of liability

To the fullest extent permitted by law, the Services are provided on an “as available” and “as is” basis, without warranties of uninterrupted access, error-free operation, or specific advertising results. We do not guarantee that any business will honor an offer, or that third-party information will remain current.

To the fullest extent permitted by applicable law, SixCrd is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including alleged lost sales, lost profits, lost customers, lost goodwill, or missed business opportunities arising from advertising delays, publication failures, or interruptions of the Services, even if advised of the possibility of such losses.

To the fullest extent permitted by law, SixCrd's aggregate liability arising from a particular paid advertising placement will not exceed the amount paid to SixCrd for that affected placement, including its associated Featured fee, if any. For other claims arising from use of free Services, SixCrd's aggregate liability will not exceed $100, to the extent permitted by law. These limits do not exclude liabilities that applicable law prohibits limiting, including liability for SixCrd's own fraud or willful misconduct where such exclusions are unlawful.

Responsibility for third-party claims

To the extent permitted by law, advertisers and contributors agree to defend and indemnify SixCrd against third-party claims, damages, and reasonable costs arising from their submitted content, infringement of others' rights, misleading offers, or violations of these Terms or applicable law, except to the extent caused by SixCrd's own wrongful acts.

Changes, suspension, and termination

We may update the Services or these Terms. Material changes will be posted here with an updated date and, when appropriate, communicated by other reasonable means. Changes apply prospectively unless otherwise required by law. We may suspend or discontinue features, subject to any outstanding paid-placement obligations and applicable refund rights.

Governing law and disputes

These Terms are governed by Nevada law, without regard to its conflict-of-law rules, except where mandatory consumer-protection laws apply. Any court proceeding relating to these Terms will be brought in a court of competent jurisdiction in Clark County, Nevada, unless applicable law requires another forum. Before filing a claim, we encourage you to contact [email protected] so we can try to resolve the issue informally.
